These Travel Agency Terms and Conditions (“Terms”) govern the relationship between The Nomad Reverie (“Agency,” “we,” “our,” or “us”) and any individual or entity (“Traveler,” “you,” or “your”) who books, purchases, or participates in travel arrangements or related services coordinated by the Agency. By booking travel services through the Agency, you agree to be bound by these Terms. Please review this document carefully before confirming your reservation.

1. Definitions

  • Traveler: Any individual or entity who books or participates in travel services arranged by the Agency, including individuals traveling independently or as part of a group.
  • Supplier(s): Third-party providers including, without limitation, airlines, hotels, cruise lines, tour operators, transportation companies, insurance providers, and other independent contractors who supply travel-related products or services.
  • Travel Services: All travel planning, booking, consulting, and coordination services provided by the Agency, including without limitation, flights, accommodations, tours, transportation, insurance, excursions, and related travel arrangements.
  • Booking: A confirmed reservation for travel services, whether paid in full or in part.

2. Description of Services

The Agency provides professional travel planning and coordination services to help clients research, organize, and complete travel arrangements suited to their interests, preferences, and budget. Our services may include, but are not limited to, destination recommendations, itinerary design, coordination of flights, hotels, transportation, excursions, and cruises, as well as assistance with visas, entry requirements, and other travel-related needs.

While the Agency strives to deliver a seamless travel experience, many travel components depend on independent Suppliers. The Agency acts solely as an intermediary between Travelers and Suppliers and cannot guarantee the performance or quality of any third-party service. All travel arrangements are subject to the terms and conditions of the applicable Suppliers, which may include separate contracts, payment schedules, and cancellation policies.

3. Booking Confirmation & Acceptance of Terms

A booking is considered confirmed once the required deposit or full payment has been successfully processed by the applicable Supplier or through an approved payment process and the applicable reservation has been confirmed. By submitting payment, you acknowledge that you have read, understood, and agreed to these Terms. Travelers must review all booking confirmations and invoices upon receipt and immediately report any discrepancies or errors. Failure to do so may result in additional fees or the inability to make corrections later. The Agency reserves the right to cancel or refuse service to anyone who fails to comply with these Terms or with Supplier requirements.

4. Deposits & Payments

Deposits and payment requirements vary by Supplier and by the travel arrangements selected. The amount of any required deposit, whether the deposit is refundable or non-refundable, and any applicable payment deadlines will be disclosed to the Traveler before booking. Supplier deposits are subject to the applicable Supplier's terms and conditions, including its cancellation, refund, and transfer policies.

Final payment is due by the date specified on the Traveler's invoice or applicable payment schedule. Reservations made after a Supplier's final payment deadline may require payment in full at the time of booking. Accepted payment methods will be communicated by the Agency and/or applicable Supplier. Failure to make payment by the required deadline may result in cancellation of reservations, forfeiture of prior payments, or additional penalties in accordance with the applicable Supplier's terms and conditions. Travelers should contact the Agency promptly regarding any disputed charge before initiating a chargeback, to the extent permitted by applicable law.

5. Agency Service Fee

The Agency provides professional travel planning, advisory, booking, and coordination services, and may charge service fees for these efforts. Agency service fees compensate for time, expertise, research, and administrative work performed in designing customized itineraries, securing reservations, and providing client support before, during, and after travel. These fees are separate from and in addition to the costs charged by Suppliers such as airlines, hotels, cruise lines, or tour operators.

The amount and structure of the Agency's professional service fees may vary depending on the complexity of the trip, number of travelers, type of travel, and level of planning or support required. Fees may include planning, consultation, booking, change, or other professional service fees. All applicable Agency fees will be disclosed to the Traveler in writing before they are charged and may be reflected in the Travel Services Agreement, fee schedule, proposal, or invoice.

Unless otherwise stated in writing, Agency professional service fees are non-refundable once paid because they compensate the Agency for time, expertise, research, planning, coordination, and other professional services performed on the Traveler's behalf. These fees remain non-refundable if the Traveler later cancels, changes travel dates, elects not to proceed with a proposed booking, or receives a refund or credit from a Supplier.

The Agency may charge additional professional or administrative fees for substantial itinerary revisions, complex modifications, last-minute requests, after-hours assistance, or additional work associated with Supplier credits or refunds. Any such Agency fee will be disclosed to the Traveler before it is charged. The Agency may pause additional planning or administrative work while outstanding Agency fees remain unpaid.

The Agency may receive commissions, incentives, overrides, or other compensation from Suppliers and/or its host agency in connection with travel arrangements booked for the Traveler. Such compensation is separate from any professional service fees charged directly to the Traveler. The receipt of Supplier compensation does not change the Agency's commitment to recommending travel options based on the Traveler's needs, preferences, budget, availability, and the Agency's professional judgment.

By engaging the Agency's services, the Traveler agrees to the fee structure as communicated at the time of booking and acknowledges that these fees are an essential component of the professional service relationship between the Traveler and the Agency.

6. Pricing, Inclusions, & Exclusions

All travel pricing provided by the Agency is based on rates, availability, taxes, fees, exchange rates, fuel costs, and other information available at the time of quotation. Unless otherwise stated in writing, quoted prices are not guaranteed until the applicable reservation is confirmed and any required payment has been successfully processed. Supplier pricing, taxes, fees, surcharges, and currency-related costs may change before or, where permitted by the applicable Supplier, after booking. If a material price change occurs before a required payment is made, the Agency will notify the Traveler as soon as reasonably possible and explain the available options, which may include accepting the revised price, selecting an alternative arrangement, or cancelling subject to the applicable Supplier's terms and cancellation policies.

Unless expressly stated in the booking confirmation, proposal, or itinerary, quoted prices include only the travel services, accommodations, transportation, activities, meals, and other items specifically identified in writing. Pricing may be based on the occupancy, room category, cabin category, fare class, or other booking conditions stated in the applicable proposal or reservation.

Items not specifically identified as included are the Traveler's responsibility and may include, without limitation, optional excursions, meals and beverages not included in the itinerary, minibar or room-service charges, laundry, telephone charges, tips and gratuities, baggage or seat-selection fees, travel insurance premiums, passport and visa costs, vaccinations or health documentation, local taxes or resort fees payable at destination, and additional accommodations or services not included in the confirmed arrangements.

Special requests, including but not limited to room locations or upgrades, bedding configurations, seat assignments, dietary preferences, accessibility requests, adjoining rooms, celebration amenities, or other preferences, are subject to Supplier availability and approval. The Agency will make reasonable efforts to communicate and facilitate such requests but cannot guarantee that any Supplier will fulfill them. Additional charges may apply. Travelers are responsible for reviewing their proposals, invoices, confirmations, and itineraries for accuracy and promptly notifying the Agency of any discrepancies. Changes requested after a reservation has been confirmed may be subject to availability, additional costs, and Supplier-imposed change or cancellation penalties.

In the event of a typographical, clerical, system, or Supplier-provided error affecting pricing, availability, dates, inclusions, or other booking details, the Agency reserves the right to correct the error and provide the Traveler with the accurate information as soon as reasonably possible. If the correction materially changes the cost or terms of the proposed travel arrangements before booking is finalized, the Traveler may choose to proceed under the corrected terms or decline the affected arrangement. If an error is discovered after booking, any available options will be determined in accordance with the applicable Supplier's terms and policies. The Agency will make reasonable efforts to assist the Traveler in resolving any such issue but cannot guarantee that an incorrectly quoted rate, availability, or other erroneous term will be honored by a Supplier.

7. Taxes & Government Fees

All travel services may be subject to applicable taxes, fees, assessments, and government- or Supplier-imposed surcharges, which vary by destination and type of service. These may include, without limitation, sales or occupancy taxes, airport or port charges, customs duties, tourism levies, environmental or sustainability fees, value-added tax (VAT), fuel surcharges, or other mandatory charges. Because these amounts are established by governments or Suppliers and may change without prior notice, the Agency cannot guarantee the exact amount of such charges until they are confirmed by the applicable Supplier or authority.

Travelers acknowledge that taxes, government fees, Supplier charges, and other mandatory assessments may increase after a reservation is made. If such an adjustment affects the Traveler's booking, the Agency will communicate the revised amount as soon as reasonably possible. The Traveler is responsible for paying any applicable increase by the required deadline. Failure to pay may affect the reservation and could result in cancellation or other penalties in accordance with the applicable Supplier's terms and policies. Certain destinations may also require taxes, resort fees, tourism fees, or other charges to be paid directly to a hotel, Supplier, or local authority upon arrival or departure. Unless specifically stated as included in the confirmed travel arrangements, such charges remain the Traveler's responsibility.

The Agency will make reasonable efforts to advise Travelers of such potential costs in advance, but ultimate responsibility rests with the Traveler to inquire about and pay any additional local charges that may apply.

In the event of a cancellation, refund, or booking adjustment, certain taxes, government fees, Supplier charges, or other amounts may be non-refundable or only partially refundable depending on the applicable Supplier or governmental authority. The Agency will make reasonable efforts to assist with any eligible refund request but cannot guarantee that taxes, fees, or other charges will be recovered. The Agency is not responsible for non-refundable amounts or for calculations, processing decisions, or delays controlled by Suppliers or governmental authorities.

8. Air Travel

Air travel is subject to the terms, conditions, schedules, policies, and operational decisions of the applicable airline. This includes, without limitation, baggage allowances and fees, seat assignments, schedule changes, cancellations, delays, denied boarding, aircraft substitutions, check-in requirements, security procedures, and identification requirements. Travelers are responsible for complying with all airline rules and for reviewing flight details before departure.

The Agency will make reasonable efforts to assist with air arrangements and to communicate known schedule changes or disruptions, but does not control airline operations and is not responsible for delays, cancellations, missed connections, lost or damaged baggage, seating changes, or other airline-related issues. Any additional costs resulting from airline changes, Traveler-requested modifications, missed flights, or travel disruptions are the Traveler's responsibility unless otherwise provided by the airline or applicable law. Travelers are strongly encouraged to reconfirm flight schedules directly with the airline before departure and to arrive at the airport within the airline's recommended check-in time.

9. Changes by Traveler

Requests to change, revise, transfer, or otherwise modify confirmed travel arrangements must be submitted to the Agency in writing. The Agency will make reasonable efforts to accommodate requested changes but cannot guarantee that any change will be available or approved. All changes are subject to current Supplier availability, pricing, terms, restrictions, and applicable change or cancellation penalties.

Requested changes may include, without limitation, changes to travel dates, traveler names, accommodations, room or cabin categories, transportation, flights, tours, activities, or other itinerary components. A requested change may result in loss of previously secured pricing, promotions, availability, deposits, or other booking benefits and may increase the total cost of the trip.

Travelers are responsible for all Supplier-imposed charges and any applicable Agency professional or administrative fees associated with requested changes. The Agency will communicate known additional costs or material changes for the Traveler's approval before completing a revision that requires additional payment. Traveler substitutions or name changes will be processed only when permitted by the applicable Supplier and subject to all required documentation, deadlines, and fees.

10. Cancellations by Traveler and Refunds

All cancellation requests must be submitted to the Agency in writing and must clearly identify whether the Traveler is requesting cancellation of the entire trip, specific Travelers, or only certain travel arrangements. The Agency will make reasonable efforts to submit the cancellation request to the applicable Suppliers as promptly as possible. Cancellation is subject to the terms, deadlines, and policies of each Supplier, and the Agency cannot guarantee that a reservation can be cancelled or that any payment will be refundable.

Deposits, payments, cancellation penalties, refunds, and travel credits are governed by the applicable Supplier's terms and conditions. Certain travel arrangements, including without limitation airline tickets, cruise fares, special-event reservations, promotional rates, tours, accommodations, or other components, may be partially or entirely non-refundable once booked. Refund or credit processing times are controlled by the applicable Supplier and may take an extended period of time. The Agency will make reasonable efforts to assist the Traveler with eligible refund or credit requests but cannot guarantee the amount, timing, method, or approval of any refund or credit.

Agency professional service fees remain subject to the refundability provisions stated in these Terms and any applicable Travel Services Agreement. Travelers remain responsible for any outstanding Supplier charges, cancellation penalties, or other amounts arising from their cancellation request. If cancellation by one or more Travelers affects occupancy requirements, group pricing, promotional rates, or other pricing conditions for the remaining Travelers, the cost of the remaining arrangements may be recalculated by the applicable Supplier.

Travelers who have purchased travel insurance are responsible for reviewing their policy and submitting any eligible claim to the insurance provider. The Agency may provide reasonable assistance with documentation but does not determine coverage, approve claims, or guarantee insurance reimbursement.

11. Agency Right to Cancel for Traveler Non-Compliance

The Agency reserves the right to suspend or terminate planning, booking, or other Travel Services if a Traveler fails to make required payments when due, materially breaches these Terms or an applicable Travel Services Agreement, provides false or materially incomplete information, fails to provide information or approvals necessary to continue planning or booking, engages in unlawful, abusive, threatening, or disruptive conduct, or otherwise fails to comply with applicable Supplier requirements.

When reasonably practicable, the Agency will provide written notice of the issue and an opportunity for the Traveler to correct it before services are terminated. Immediate termination may occur when continued service would be unlawful, unsafe, commercially unreasonable, or materially disruptive.

If services are suspended or terminated, the Traveler remains responsible for Agency professional service fees already earned, amounts already paid or owed to Suppliers, and any applicable cancellation, change, or other penalties imposed by Suppliers. Any refund or travel credit for Supplier payments will be governed by the applicable Supplier's terms and conditions. The Agency will not guarantee the recovery of funds from Suppliers and will not be responsible for losses resulting from the Traveler's non-compliance.

12. Changes and Other Cancellations by Agency or Suppliers

Travel arrangements may be changed, delayed, substituted, or cancelled by Suppliers for reasons outside the Agency's control, including availability, operational issues, schedule changes, weather, safety concerns, government actions, insufficient participation, Supplier insolvency, or Force Majeure Events. The Agency will make reasonable efforts to notify affected Travelers and assist with available alternatives but cannot guarantee that the original itinerary, pricing, accommodations, transportation, activities, or other arrangements will remain available.

If a Supplier materially changes or cancels a confirmed travel arrangement, the Traveler's rights to a refund, travel credit, rebooking, substitute service, or other remedy will be determined by the applicable Supplier's terms and conditions and applicable law. The Agency will make reasonable efforts to communicate available options and assist the Traveler in pursuing any eligible remedy but does not control Supplier decisions, processing timelines, or the amount or form of any refund or credit.

If the Agency determines that a change to the planning or coordination of Travel Services is reasonably necessary because of circumstances outside its control, it will make reasonable efforts to provide an appropriate alternative and communicate any material change to the Traveler. Any additional Supplier costs associated with replacement or revised arrangements will be disclosed before the Traveler is asked to approve them whenever reasonably practicable.

If the Agency independently cancels its professional Travel Services for reasons not caused by Traveler non-compliance, the Agency will communicate the cancellation in writing and reasonably assist with transitioning any existing Supplier reservations or records that can appropriately be transferred. Any refund of Agency professional service fees will be determined based on the services already performed, the applicable Travel Services Agreement, and applicable law. Supplier payments, refunds, credits, and penalties remain subject to the applicable Supplier's terms.

In the event a Supplier ceases operations, becomes insolvent, or otherwise fails to provide contracted services, the Agency will make reasonable efforts to assist the Traveler with available alternatives, Supplier refund or credit requests, insurance claims, or other appropriate remedies. The Agency does not guarantee recovery of funds or assume responsibility for Supplier insolvency or default.

13. Refunds and Reimbursement

Any refund, reimbursement, or travel credit related to a Supplier booking is subject to the applicable Supplier's terms, conditions, eligibility requirements, and processing procedures. The Agency does not control whether a Supplier approves a refund or credit, the amount approved, the method of reimbursement, or the time required for processing.

When a Traveler may be eligible for a Supplier refund or credit, the Agency will make reasonable efforts to assist with submitting or facilitating the request. Any amount returned to the Traveler will be limited to funds actually recovered or made available by the applicable Supplier, less any permitted Supplier penalties, non-refundable amounts, or Agency fees that are separately due under these Terms or an applicable Travel Services Agreement.

Refunds will generally be returned to the original payer or original method of payment when required by the Supplier or payment processor. The Agency is not responsible for delays, denials, expired travel credits, changes in Supplier policies, or other decisions outside the Agency's control.

Agency professional service fees are governed separately by the service-fee provisions of these Terms and any applicable Travel Services Agreement and are not automatically refundable merely because a Supplier provides a refund or travel credit.

14. Traveler Responsibilities

Travelers are responsible for providing complete and accurate information requested by the Agency, including legal names as they appear on travel documents, dates of birth, contact information, passport or identification details when required, loyalty information, accessibility needs, dietary restrictions, and other information reasonably necessary to plan or book travel. Travelers must promptly notify the Agency if any information changes.

Travelers are responsible for carefully reviewing all proposals, invoices, booking confirmations, itineraries, tickets, vouchers, and other travel documents provided by the Agency. Any spelling errors, incorrect dates, traveler information, reservation details, or other discrepancies must be reported as soon as possible. The Agency is not responsible for additional costs or travel disruptions resulting from inaccurate information supplied by the Traveler or a Traveler's failure to timely review and report errors.

Travelers are responsible for complying with all applicable laws, Supplier rules, destination requirements, payment deadlines, check-in requirements, and scheduled departure or meeting times. Travelers must conduct themselves appropriately and may be responsible for costs or consequences resulting from unlawful, abusive, unsafe, or disruptive conduct. The Agency is not responsible for missed flights, transfers, tours, reservations, or other services caused by a Traveler's late arrival or failure to appear as scheduled.

Unless specifically included in the confirmed travel arrangements, Travelers are responsible for personal and incidental expenses, including optional activities, meals and beverages, baggage or seat fees, gratuities, medical expenses, emergency transportation, and other costs incurred during travel.

15. Travel Insurance

The Agency strongly recommends that all Travelers consider purchasing comprehensive travel insurance appropriate for their individual circumstances and trip. Depending on the policy selected, travel insurance may provide coverage for certain events such as trip cancellation or interruption, medical emergencies, emergency evacuation, travel delays, baggage loss or delay, Supplier insolvency, and other covered losses.

The Agency may provide information regarding available insurance options or providers; however, the Agency is not an insurance company and does not guarantee that any particular policy, benefit, claim, loss, or circumstance will be covered. Insurance coverage, eligibility, exclusions, limits, claims decisions, and reimbursement are determined solely by the applicable insurance provider and policy terms.

Travelers are responsible for reviewing insurance options, policy documents, coverage limits, exclusions, eligibility requirements, and purchase deadlines and for determining whether the selected coverage is appropriate for their needs. Travelers who elect to purchase insurance independently are responsible for obtaining and maintaining that coverage.

If a Traveler declines travel insurance or elects to obtain coverage elsewhere, the Agency may require the Traveler to complete an acknowledgment documenting that decision. Travelers who decline or fail to obtain adequate coverage accept responsibility for financial losses or expenses that may otherwise have been eligible for insurance coverage.

16. Health, Safety, and Special Needs

Travelers are responsible for informing the Agency, as early as reasonably possible, of any accessibility needs, mobility assistance, dietary restrictions, allergies, or other accommodations that may be relevant to the planning or booking of their travel arrangements. Travelers are not required to disclose private medical information beyond what is reasonably necessary for the Agency to understand and communicate a requested accommodation or travel-related need.

The Agency will make reasonable efforts to communicate accommodation and special-request information to applicable Suppliers; however, the Agency does not control Supplier facilities, policies, staffing, equipment, or accessibility and cannot guarantee that any requested accommodation will be available or fulfilled. Travelers are responsible for determining whether destinations, transportation, accommodations, excursions, and activities are appropriate for their individual needs before participating.

Travelers are responsible for consulting appropriate medical professionals when necessary regarding their ability to travel, participate in planned activities, obtain vaccinations or other health precautions, and manage medications or medical devices during travel. Travelers should carry an adequate supply of necessary medications and medical supplies and should plan for possible travel delays or disruptions.

The Agency may provide general travel-health or destination information for convenience but does not provide medical advice and does not guarantee the accuracy or continued applicability of third-party health guidance. Travelers are responsible for reviewing current information from qualified medical professionals and appropriate governmental or public-health authorities.

Medical care, hospitalization, emergency evacuation, medications, and other health-related expenses incurred during travel are the Traveler's responsibility, subject to any applicable insurance coverage. The Agency is not responsible for the acts or omissions of medical providers, Suppliers, or other third parties providing health, accessibility, or emergency services.

17. International Travel Requirements

Travelers are responsible for determining and satisfying all passport, visa, immigration, customs, transit, health, and entry requirements applicable to their travel. Requirements may vary based on citizenship, residency, destination, transit points, itinerary, and other individual circumstances and may change at any time.

Travelers are responsible for ensuring that passports and other identification documents meet the validity and blank-page requirements of all destinations and transit countries included in their itinerary. Travelers must also obtain any required visas, transit visas, electronic travel authorizations, permits, health documentation, vaccinations, or other approvals before departure.

The Agency may provide general information or resources regarding travel requirements as a convenience but does not provide legal, immigration, or medical advice and cannot guarantee that third-party information remains complete or current. Travelers should independently verify applicable requirements with appropriate government authorities, embassies, consulates, airlines, cruise lines, or other relevant Suppliers sufficiently in advance of travel.

Failure to obtain or maintain required documentation or meet applicable entry, transit, or health requirements may result in denied boarding, denied entry, delays, cancellation, quarantine, fines, rebooking expenses, or other losses. The Traveler is responsible for costs or consequences arising from failure to satisfy applicable requirements.

Any assistance provided by the Agency with identifying or obtaining travel documentation does not transfer responsibility for compliance from the Traveler to the Agency.

18. Government Travel Advisories and Warnings

Travelers are responsible for reviewing and monitoring current travel advisories, safety notices, health guidance, entry restrictions, and other official information applicable to their destinations before and during travel. Relevant information may be issued by the U.S. Department of State, Centers for Disease Control and Prevention (CDC), foreign governments, local authorities, or other governmental or public-health agencies.

The Agency may provide links, reminders, or general information regarding such advisories as a convenience, but does not guarantee that the information provided is complete, current, or applicable to every Traveler's individual circumstances. Travelers are responsible for independently reviewing official sources and making their own informed decisions regarding whether to travel.

U.S. citizens are encouraged to consider enrolling in the U.S. Department of State's Smart Traveler Enrollment Program (STEP) when appropriate. Travelers of other nationalities should consult the comparable resources provided by their country of citizenship or residence.

Travel advisories, warnings, or changes in government guidance may affect transportation, accommodations, activities, entry requirements, insurance coverage, or other aspects of a trip. Any cancellation, change, refund, or credit resulting from such circumstances remains subject to the applicable Supplier's terms, insurance policy provisions, these Terms, and applicable law.

19. U.S. Identification and REAL ID Requirements

Travelers are responsible for carrying valid identification that satisfies all applicable federal, state, transportation-provider, and security requirements for their travel. For U.S. domestic commercial air travel, Travelers must present identification accepted by the Transportation Security Administration (TSA), which may include a REAL ID-compliant driver's license or identification card, valid passport, or another form of identification accepted by the TSA.

Identification requirements may change, and Travelers are responsible for verifying current requirements before departure. The Agency may provide general information or reminders as a convenience but does not guarantee that any particular form of identification will be accepted. The Agency is not responsible for denied boarding, delays, additional costs, or other travel disruptions resulting from a Traveler's failure to carry acceptable identification.

20. Electronic Travel Authorization and Entry Permissions

Travelers are responsible for obtaining any electronic travel authorizations, visa waivers, entry permits, or other pre-travel approvals required for their destinations or transit points, including programs such as ETA, ETIAS, ESTA, or similar systems.

Requirements may vary based on citizenship, residency, passport type, destination, transit country, length of stay, and purpose of travel, and may change at any time. Travelers are responsible for verifying applicable requirements through official government sources and completing all required applications accurately and within the required timeframe.

The Agency may provide general information or reminders regarding electronic travel authorizations as a convenience but does not submit applications on the Traveler's behalf unless separately agreed in writing and does not guarantee approval, processing time, or continued validity of any authorization.

Failure to obtain a required authorization may result in denied boarding, denied entry, delays, cancellation, additional expenses, or other travel disruptions. The Traveler is responsible for any costs or losses arising from failure to obtain or maintain the required authorization.

21. Minors Traveling

Parents, legal guardians, and other responsible adults are solely responsible for ensuring that any minor Traveler satisfies all identification, passport, visa, consent, custody, and entry requirements applicable to the trip. Requirements may vary depending on the minor's age, citizenship, destination, transit points, traveling companions, and family or custody circumstances.

Minors traveling without one or both parents or legal guardians may be required to carry additional documentation, which may include a notarized parental consent letter, custody documentation, birth certificate, proof of guardianship, or other records required by governments, airlines, cruise lines, or other Suppliers.

The Agency may provide general information or reminders regarding travel requirements for minors but does not provide legal advice and cannot determine whether a particular document will satisfy government or Supplier requirements. Parents and guardians are responsible for independently verifying all applicable requirements before departure.

Parents, guardians, or other responsible adults traveling with minors remain responsible for their supervision, care, safety, conduct, and compliance with Supplier rules throughout the trip. The Agency is not responsible for denied boarding, denied entry, delays, additional expenses, or other disruptions resulting from missing, incomplete, or unacceptable documentation for a minor Traveler.

22. Photography and Media

The Agency will not use a Traveler's photographs, videos, testimonials, or other personally identifiable media for marketing or promotional purposes without the Traveler's separate permission.

Travelers may voluntarily provide photographs, videos, or other media to the Agency after travel. Any permission granted for the Agency to use such media will be governed by a separate Media & Photo Release or other written authorization completed by the Traveler.

A Traveler's decision not to grant media permission will not affect the Travel Services provided by the Agency.

Travelers who voluntarily submit media for promotional use are responsible for ensuring that they own the media or have the right to share it and that they have obtained any necessary permission from other identifiable individuals appearing in the media.

23. Accuracy of Information

The Agency makes reasonable efforts to ensure that information provided in proposals, itineraries, invoices, confirmations, website content, and other materials is accurate at the time it is provided. However, travel information, pricing, availability, schedules, Supplier policies, and destination requirements may change, and errors or omissions may occasionally occur.

If the Agency discovers an error in pricing, dates, availability, inclusions, Supplier information, or other booking details, the Agency will notify the Traveler as soon as reasonably possible and provide the corrected information. Before a booking is finalized, the Traveler may choose whether to proceed under the corrected terms.

If an error is discovered after a booking has been confirmed, any available correction, cancellation, refund, credit, or rebooking option will be determined by the applicable Supplier's terms, these Terms, and applicable law. The Agency will make reasonable efforts to assist the Traveler but cannot guarantee that an incorrect rate, availability, schedule, or other erroneous term will be honored by a Supplier.

Travelers are responsible for carefully reviewing all proposals, invoices, confirmations, tickets, and itineraries and promptly notifying the Agency of any suspected error or discrepancy.

24. Force Majeure

The Agency is not responsible for delays, changes, cancellations, interruptions, or failure to provide Travel Services resulting from events or circumstances beyond the Agency's reasonable control ("Force Majeure Events"). Such events may include, without limitation, severe weather, natural disasters, fire, flood, epidemics or pandemics, war, terrorism, civil unrest, strikes or labor disputes, government actions or restrictions, border closures, transportation disruptions, Supplier failures, public-health emergencies, or other unforeseen events outside the Agency's control.

If a Force Majeure Event affects a Traveler's arrangements, the Agency will make reasonable efforts to communicate available information and assist the Traveler with alternatives, rescheduling, Supplier credits, refunds, or other available remedies. Any such remedy is subject to the applicable Supplier's terms and conditions, availability, insurance coverage, and applicable law.

Travelers are responsible for any additional costs associated with revised or replacement arrangements unless those costs are covered or reimbursed by a Supplier, insurance provider, or other responsible third party. The Agency does not guarantee that replacement arrangements will be available at the same price or that any Supplier will provide a refund or credit.

A Force Majeure Event does not automatically entitle a Traveler to a refund of Agency professional service fees already earned or services already performed. Supplier payments, refunds, credits, and cancellation penalties remain subject to the applicable Supplier's terms and conditions. Travelers are strongly encouraged to maintain appropriate travel insurance for risks associated with unforeseen events and travel disruptions.

25. Electronic Communications

By providing an email address, telephone number, or other contact information, Travelers consent to receive communications from the Agency that are reasonably necessary to plan, book, manage, and support their travel arrangements. These communications may include proposals, booking confirmations, invoices, receipts, itineraries, payment reminders, schedule changes, travel alerts, document requests, appointment information, and other trip-related notices.

The Agency may communicate by email, telephone, text message, or other electronic means using the contact information provided by the Traveler. Travelers are responsible for keeping their contact information current and for regularly monitoring communications related to their trip.

Marketing or promotional communications will be sent only in accordance with applicable law and the Traveler's applicable communication preferences or consent. Travelers may opt out of non-essential marketing communications at any time without affecting their receipt of necessary trip-related communications.

Travelers acknowledge that electronic communications may involve security or delivery risks outside the Agency's reasonable control. Travelers should not send sensitive information, including full credit-card numbers, passwords, or other highly confidential information, through ordinary email or text message when a secure method is available.

26. Data Protection and Privacy

The Agency may collect, use, and store personal information reasonably necessary to provide Travel Services, communicate with Travelers, process bookings, coordinate with Suppliers, and satisfy legal or regulatory requirements. Such information may include names, contact information, dates of birth, passport or identification information, loyalty-program information, travel preferences, accessibility or dietary needs, emergency-contact information, and payment-related information.

The Agency may disclose relevant personal information to Suppliers, host agencies, payment processors, insurance providers, technology service providers, governmental authorities, or other third parties when reasonably necessary to plan, book, manage, or support the Traveler's arrangements or to comply with applicable legal requirements. Only information reasonably necessary for the applicable purpose should be shared.

The Agency will use reasonable administrative, technical, and organizational safeguards to protect personal information in its possession. Travelers acknowledge, however, that no electronic storage, transmission, or communication system can be guaranteed to be completely secure. Travelers should use secure methods provided by the Agency when submitting sensitive information, including passport information and payment details.

Travelers are responsible for providing accurate information and promptly notifying the Agency of corrections or changes. Requests regarding access to, correction of, or deletion of personal information will be handled in accordance with applicable law and the Agency's Privacy Policy, subject to any information the Agency must retain for legitimate business, contractual, tax, insurance, regulatory, or recordkeeping purposes.

27. Indemnification

To the extent permitted by applicable law, the Traveler agrees to indemnify and hold harmless the Agency, its owners, employees, agents, and affiliates from third-party claims, liabilities, damages, penalties, costs, or reasonable legal expenses arising directly from:

  • the Traveler's material breach of these Terms or an applicable Travel Services Agreement;
  • the Traveler's violation of applicable law, government requirements, or Supplier rules;
  • materially false, inaccurate, or incomplete information provided by the Traveler;
  • the Traveler's negligent, unlawful, abusive, or intentionally wrongful conduct; or
  • damage or injury caused by the Traveler to a Supplier, another Traveler, or other third party.

This indemnification obligation does not apply to the extent a claim results from the Agency's own negligence, willful misconduct, or breach of its contractual obligations.

Nothing in this Section makes the Traveler responsible for the independent acts, omissions, negligence, or misconduct of Suppliers or other third parties merely because the Agency arranged the applicable travel service.

28. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

29. No Waiver

The failure of either party to enforce any provision of these Terms, or the waiver of any breach of these Terms, will not be construed as a continuing waiver or as a waiver of any subsequent breach. All provisions of these Terms will remain in full force and effect unless expressly modified or waived in writing.

30. Governing Law

These Terms and any dispute arising out of or relating to these Terms, the Travel Services, or any Booking shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict-of-law principles, except to the extent applicable federal law or other non-waivable legal requirements apply.

31. Arbitration and Dispute Resolution

To the extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, the Travel Services, or any Booking that cannot be resolved informally between the parties shall be resolved through final and binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules and Mediation Procedures then in effect.

The arbitration will be conducted in accordance with the procedures and location requirements established by the applicable AAA Consumer Arbitration Rules, unless the parties mutually agree otherwise. Arbitration fees and costs will be allocated in accordance with the AAA Consumer Arbitration Rules and applicable law. Each party will be responsible for its own attorneys' fees unless otherwise awarded by the arbitrator or permitted by applicable law.

Judgment on the arbitration award may be entered in any court having jurisdiction. To the extent permitted by applicable law, the Traveler and the Agency waive the right to a trial by jury and agree that claims will be brought on an individual basis rather than as part of a class, collective, or representative action.

32. Notices

Any formal notice required under these Terms must be provided in writing. Notices may be delivered by email to the most recent email address provided by the Traveler or Agency, by nationally recognized overnight courier, by certified or registered mail, or by another written method mutually agreed upon by the parties.

A notice sent by email will be considered delivered when sent, provided the sender does not receive notice that the message was undeliverable. Notices sent by courier or mail will be considered delivered according to the applicable delivery confirmation or tracking record.

Travelers are responsible for keeping their email address, mailing address, telephone number, and other contact information current with the Agency.

33. Disclaimer, Limitation of Liability, and No Warranties

The Agency acts as an advisor, coordinator, and intermediary for independent third-party Suppliers, including airlines, hotels, cruise lines, tour operators, transportation providers, excursion operators, insurance providers, and other travel-service providers. The Agency does not own, operate, manage, or control those Suppliers and, to the extent permitted by applicable law, is not responsible for their independent acts, omissions, delays, cancellations, defaults, insolvency, service failures, or other conduct.

Travel involves inherent risks and circumstances that may be outside the Agency's control, including illness, injury, weather, transportation disruptions, government actions, Force Majeure Events, destination conditions, and changes made by Suppliers. Travelers are responsible for complying with applicable documentation, entry, health, safety, and Supplier requirements and for making informed decisions regarding their participation in travel.

To the fullest extent permitted by applicable law, the Agency will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Travel Services, Booking, or trip, including lost enjoyment, lost time, emotional distress, or additional expenses resulting from circumstances beyond the Agency's reasonable control.

To the fullest extent permitted by applicable law, the Agency's aggregate liability for direct damages arising from the Agency's performance of professional Travel Services will not exceed the amount of Agency professional service fees actually paid by the affected Traveler for the services giving rise to the claim. This limitation does not apply to liability that cannot lawfully be limited or excluded.

The Agency makes no warranty or guarantee regarding the availability, safety, quality, suitability, performance, or outcome of services provided by independent Suppliers. The Agency will use reasonable professional efforts in providing its own Travel Services but cannot guarantee a particular travel experience or Supplier performance.

Nothing in these Terms is intended to exclude or limit liability to the extent such exclusion or limitation is prohibited by applicable law.

34. Host Agency and Seller of Travel Disclosure

The Nomad Reverie is a WorldVia Travel Network Independent Agency, affiliated with WorldVia Travel Network, a Travel Leaders Network Associate. Travel services booked through The Nomad Reverie are provided in connection with its host-agency relationship with WorldVia Travel Network.

Seller of Travel registration and disclosure requirements vary by jurisdiction. The Nomad Reverie will comply with all Seller of Travel, registration, disclosure, recordkeeping, and consumer-protection requirements applicable to its operations, whether satisfied directly or through its host-agency relationship with WorldVia Travel Network.

The Agency makes no representations regarding the licensing or registration requirements of Suppliers outside of the United States. Travelers booking international services understand that Supplier operations abroad may not be subject to the same consumer protection standards as those in the U.S.

35. Trust Account Disclosure and Client Funds Processing

The Nomad Reverie does not maintain a separate client trust account for funds intended for third-party travel Suppliers. Payments for travel arrangements are processed directly by the applicable Supplier and/or through WorldVia Travel Network in accordance with the applicable payment procedures, Supplier terms, and host-agency requirements.

The Nomad Reverie may collect professional planning, consultation, or other Agency service fees using approved payment-processing methods. Such Agency fees are separate from amounts charged by third-party Suppliers for travel arrangements.

Refunds, travel credits, payment reversals, and other adjustments relating to Supplier charges are subject to the applicable Supplier's terms and payment procedures. The Nomad Reverie will make reasonable efforts to assist Travelers with eligible refund or credit requests but does not control Supplier processing timelines or decisions.

The Agency will handle and process funds in accordance with applicable law and any requirements imposed through its host-agency relationship with WorldVia Travel Network.
